Hitler Nwuala, a digital forensic expert, testified at the Presidential Election Petition Court in Abuja that the Independent National Electoral Commission (INEC) intentionally erased all results from the BVAS machines used in the Federal Capital Territory during the presidential election. Nwuala, who was the 26th witness for the PDP’s presidential candidate, Atiku Abubakar, stated that he examined 110 BVAS devices used during the election and found that all the machines had their data erased. During cross-examination by INEC’s lawyer, Abubakar Mahmoud, Nwuala argued that there was no need for INEC to delete the presidential election result data from the BVAS machines used in the FCT since the FCT does hold governorship elections.
During his evidence-in-chief, Nwuala was questioned by the lead counsel for the petitioners, Chief Chris Uche. He testified that he examined 110 BVAS machines as a sample material from the FCT and submitted a report on his investigation into the Bimodal Voter Accreditation System. Despite objections from the respondents, the report was admitted as evidence and marked as exhibits. The petitioners also provided a certificate of compliance to indicate that the report had satisfied the requirements of the Evidence Act. The proceedings was adjourn until Friday, June 23, when further hearings into the petition will continue. The outcome of this case could have significant implications for the outcome of the Nigerian presidential election held on February 25.
