In Port Harcourt, a Rivers State High Court has rejected the bail application of Sunny Bekanwah, the former chairman of Khana local government area. Bekanwah is facing charges of alleged sponsorship of cultism and involvement in the murder of Dr. Lucky Kinain.
The denial of bail came as a ruling by Hon. Justice Daketima Kio, who presided over the case, and the decision was based on the need to ensure the accused remains in custody throughout the trial.
The charges against Bekanwah and another individual, Barikui Henry Deele, originated from the confessionary statement of a suspected cultist linking the duo to the reported activities. The Commissioner of Police in the state formally instituted the case, with Deele as the first defendant and Bekanwah as the second defendant.
Despite the efforts of Bekanwah’s counsel, Kennedy Amos Simeon, to secure bail, the judge emphasized the evolving nature of bail applications, highlighting the importance of proving the necessity of temporary freedom.
Justice Daketima Kio considered factors such as the common involvement of both suspects in cult activities in Kpea community. While acknowledging that ill-health could be a consideration for bail, the judge found the applicant’s presentation lacking in proving the severity of the claimed ailment.
Furthermore, Kio expressed surprise at the timing of medical documentation, noting inconsistencies and raising questions about the applicant’s credibility in seeking bail on health grounds.
